  1. Object

    These General Conditions regulate the acquisition of products offered on the website www.tenstickers.nz, which is owned by TENVINILO S.L. (Hereinafter, TENVINILO). The acquisition of any of the products entails the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Particular Conditions that could be applicable when acquiring certain products. These General Conditions may be modified without prior notice; therefore, it is recommendable to read carefully its contents before proceeding to the acquisition of any of the products offered.

    All notifications and communications between Users and TENVINILO will be considered effective, for all purposes, when they are made through any means described above.
  4. Products

    The products offered by TENVINILO are stickers and mediums of decoration. These products, along with their main characteristics and their price appear on the screen.

    TENVINILO mainly markets products manufactured at the user's request in a personalized way, although standardized products are also offered.

    TENVINILO reserves the right to decide to withdraw or add, at any moment, the products and / or services offered to Customers. In this way, TENVINILO may, at any time, add new products and / or services to those currently offered. TENVINILO also reserves the right to withdraw or cease to offer, at any time, and without prior notice, any of the products offered.

    Once inside www.tenstickers.nz, to access the ordering and therefore acquisition of different products, the User must follow all the instructions indicated in the purchase process, which will mean the reading and acceptance of all the general and particular conditions fixed at www.tenstickers.nz.

  5. Availability and substitutions

    TENVINILO intends to guarantee the availability of all the products that are advertised through www.tenstickers.nz, since it works to order. However, in the event that any requested product is not available or if it has been exhausted, the customer will be informed by email as soon as possible.

    If the product is not available and the consumer has been informed of it, TENVINILO may supply a product of similar characteristics without price increase, in which case the consumer may accept or reject it by exercising his right of withdrawal and dissolution of the contract.

    In case of unavailability of all or part of the order, and rejection of substitute products by the customer, the refund previously paid will be made by the same payment method for which the purchase was made. If TENVINILO is unreasonably delayed in returning the amounts paid, the consumer may claim twice the amount owed.

  6. Purchasing Process and/or Contracting

    In order to make any purchase in www.tenstickers.nz, it is necessary that the customer is of legal age.

    In addition, it will be necessary for the client to complete a data collection form on www.tenstickers.nz providing TENVINILO with the necessary information for the contract; data that, in any case, will be truthful, accurate and complete on its identity and that the customer must expressly consent through the acceptance of the TENVINILO privacy policy. If the user wishes to keep track of the process of his order he can register, indicating so in that same form.

    The steps to follow to make the purchase are:
    1. Select the desired product whose characteristics appear on the screen or describe the product or attach the custom design you want.
    2. . Once the product has been selected and before confirming the purchase, you must complete the data collection form, accept the Privacy Policy and the General Conditions of Contract.
    3. . Confirm the order and make the payment through the selected means of those offered.
    4. . Once the payment has been made, you will receive a confirmation email within a period of no more than 24 hours.

  7. Duration, Renewal and Cancellation of Contract

    DURATION

    The duration of the contract coincides with the completion of the order and the contract ends with the final and definite delivery of the product.
  8. Delivery

    The order will be delivered at the address designated by the customer at the time of the contract according to the chosen modality. The delivery area includes the following areas: Mainland United Kingdom of Great Britain and Northern Ireland

    FORMS AND DELIVERY TERMS

    According to the company and type of transport chosen by the user to make the order: The maximum delivery time is 20/30 working days (does not include Saturdays, Sundays or holidays).

    The delivery time may be extended by 5/10 days from the maximum delivery time in certain circumstances attributable to the transport agency due to reasons as such: delayed transit shipment, problems channelling the shipment, customs clearance, high workload during peak seasons, pandemic periods or other circumstances beyond Tenstickers's control.

    For orders delivered by the National Postal Operator, products that exceed the width and height of 75cm will be produced in separate pieces.

  9. Price, Expenses and Taxes

    The prices of the products that are collected in www.tenstickers.nz will be expressed in New Zealand dollars unless otherwise stated and will be guaranteed during the validity of the same, except for printing error and regardless of the destination of the order.

    PRODUCTS

    The final prices of all products (and, where applicable, final prices per unit of measurement, where mandatory) along with their characteristics, offers, discounts, etc. are reflected in each of the articles appearing in the catalog of www.tenstickers.nz

    • For customers who are residents of the European Union, all prices include VAT.
    • For orders being shipped to countries outside of the European Union , no VAT and no sales tax will be included in the product prices you see on our website and you will not be charged any taxes by us.
      However your packages may be subject to the customs fees and import duties of the country to which your order is shipped to. So the courier will charge you any taxes or customs directly. As taxes and customs may also depend on product category as well as declared amount, we are not able to provide you with any further details. We would recommend you to consult your local Customs office, which will happily assist you with further information.
    • As a professional client in a country belonging to the European Union, your delivery will be exempted from VAT if, once the order has been made, you provide us with your intra-operator number by email.
    • Delivery prices can vary based upon the size and weight of the order.

    Product prices may change at any time. In this case, the price to be applied will be the one in force on the date of ordering. In any case, the final cost will be communicated to the customer in the electronic purchase process before it will formalize its acceptance.

  11. Return Policy and Withdrawal

    According to the regulations, the consumer and user will have the right to DESIST the contract for a maximum period of 14 calendar days without having to indicate the reason and without incurring any costs, except those provided for in art. 107.2 and 108 of RD1 / 2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users.

    1. Exception:

      The consumer's right of withdrawal does not apply to any products made for the consumer in a personalised way. This includes all products where the measurements, characteristics, design commissioned and / or product cut (for transport reasons) is selected or manipulated by the user (1). This exception is established in Article 103. Section c) of the aforementioned rule:

      "c) The supply of goods made according to consumer and user specifications or clearly personalized."

      (1) A product will be considered personalised if when purchasing it, the customer selects a means of transport for which it is indicated that, if the article exceeds certain measures, it must be cut and sent in two or more pieces.

      In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16 (Art. 115), which approves the consolidated text of the General Law for the Defense of Consumers and Users, the customer is informed that the right of withdrawal will not be applicable in cases where the return of the product is based exclusively on a subjective appreciation of its texture, finish, or any other sensory perception, as long as the product corresponds to the description and characteristics indicated on the product sheet.

      The customer acknowledges and accepts that, before finalizing the purchase, they have had access to all relevant information about the product, including its detailed description and illustrative images, so that their purchasing decision has been made with full knowledge of its attributes.

      Therefore, returns will not be accepted for discrepancies in the customer's personal perception of the product's texture or finish, except in cases where manufacturing defects, shipping errors, or objective non-compliance with the described specifications occur.

      Any product, physical or digital, created through the "create your Avatar" tool is considered to be created in a personalised way for the customer. Therefore, the right of withdrawal cannot be exercised.

      Therefore, at the moment the user declares to have read the General Conditions of Contract, he consents and is aware that he cannot exercise the right of withdrawal with respect to the products elaborated under his indications.

    2. Standard Products:

      The standard products will be those offered on the web with a predetermined design, measurements and colors. Regarding these products, the user can exercise the right of withdrawal.

      The client will have a maximum period of 14 calendar days from the day of receipt of the goods or product requested to inform TENVINILO about their desire to desist from the contract.

      The desisting implies that, TENVINILO will proceed to the refund of the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the product purchased is not within the exceptions indicated previously).

      During this period, the consumer will inform the organization of his decision to withdraw from the contract by sending an email to the TENVINILO e-mail address.

      TENVINILO will inform the consumer through a durable medium of an acknowledgment of receipt of such desisting.

      To proceed to the return of a product it is essential that the same is in perfect condition and with its corresponding original packaging, with all its accessories and without having been used.

      Once we receive the request we will contact the client to indicate the details of the return.

      The client will bear the costs of returning the goods.

  12. Warranty

    The products purchased through www.tenstickers.nz enjoy a warranty period of two years from the moment of purchase, covering possible manufacturing defects of the product.

    Deficiencies caused by improper use or manipulation, improper installation or defects arising from any external cause are excluded from the guarantees.   13. Liability and Disclaimer

    The consumer and user has the right to have the product repaired, to replace it, to reduce the price or to terminate the contract, as established in Chapter II Tit. IV Book II of the General Law for the Defence of Consumers and Users.

    If the product does not conform to the contract, the consumer may choose between repairing or replacing the product, both being available and free to the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.

    If the repair is completed and the product is delivered, and still does not comply with the contract, the consumer may demand its replacement, price reduction or contract termination.

  14. Customer service and claims

    In order to file any complaint or claim to TENVINILO the customer should contact the customer service department via the email address info.nz@tenstickers.com . According to the EU Online Consumer Dispute Resolution and pursuant to Article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute settlement platform available at the following link: ODR.
  15. Applicable Legislation

    The present conditions will be governed by current Spanish legislation.

    The language used will be Spanish or Catalan.

    In case of having to resort to the Courts to settle any controversy between the parties, if the user is a consumer, the Courts and Tribunals of his domicile will be applicable.
